3. Scope of services and “as is” nature of the Site
The Site provides information about our educational programs, instructor development workshops, and movement education resources. We may update, remove, or modify parts of the Site at any time, including changing content structure, resource topics, or the way we present programs.
The Site is provided on an “as is” and “as available” basis. We do not guarantee that the Site will be uninterrupted, error-free, or available at all times.
4. Acceptable use
You agree to use the Site in a lawful manner and not to misuse it. In particular, you agree not to:
- Attempt to gain unauthorized access to the Site, servers, or systems connected to the Site.
- Probe, scan, or test the vulnerability of the Site or bypass security or authentication measures.
- Use any automated means (including bots, scrapers, or crawlers) to access, copy, or extract content except as permitted by applicable law and standard search engine indexing.

5. Educational content and responsibility
Our content focuses on learning: movement vocabulary, posture awareness, scaling options, and teaching methodology. We may describe concepts such as motor learning, joint range, coordination constraints, and cueing strategies. These are educational frameworks, not clinical assessment tools.
You remain responsible for your decisions and actions. This includes deciding whether to participate in a workshop, how to interpret educational guidance, and whether to consult an appropriate regulated health professional in Canada if you have questions that require clinical assessment. If you experience pain, dizziness, or other concerning symptoms, you should stop and seek appropriate care.
6. Intellectual property
The Site and its content, including text, structure, graphics, logos, program names, materials, and design, are owned by or licensed to Milan Movement Academy Canada Inc. and are protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, publicly display, modify, create derivative works from, or exploit any portion of the Site without our prior written consent, except where permitted by applicable law.
7. Third-party services and links
The Site may reference third-party services used for infrastructure or measurement (for example, mapping links or service providers described in our Privacy Policy). If the Site includes links to third-party websites, those sites are not under our control and are provided for convenience only.
We are not responsible for third-party content, policies, or practices. Your use of third-party services is subject to the third party’s terms and privacy policies.
8. Disclaimer of warranties
To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, regarding the Site and its content, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We do not warrant that the Site will meet your requirements, that content will be complete or current in all respects, or that access will be uninterrupted or secure. Educational content may evolve as standards change and as we refine curricula.
9. Limitation of liability
To the fullest extent permitted by applicable law, Milan Movement Academy Canada Inc. and its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your access to or use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total liability for all claims arising out of or relating to the Site or these Terms will not exceed the greater of (a) the amount you paid to us in the 12 months before the event giving rise to the claim, or (b) CAD $100.
Some jurisdictions do not allow certain limitations of liability, so parts of the above may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless Milan Movement Academy Canada Inc. and its directors, officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site, (b) your breach of these Terms, or (c) your violation of any law or the rights of a third party.
11. Force majeure
We are not responsible for delays or failures to perform resulting from causes beyond our reasonable control, including natural disasters, power outages, labour disputes, war, pandemics, internet or telecommunications failures, cyberattacks, and failures of third-party hosting or cloud providers.
12. International use
The Site is operated from Canada. We make no representation that the Site is appropriate or legally available for use in every jurisdiction. If you access the Site from outside Canada, you do so at your own initiative and are responsible for compliance with local laws.
13. Governing law and jurisdiction (Canada)
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought in the courts located in Toronto, Ontario, Canada, and you consent to the personal jurisdiction of such courts.
If you are a consumer and the laws of your jurisdiction provide you with non-waivable rights, those rights remain in effect to the extent applicable.
14. Dispute resolution (informal first)
Before starting formal legal proceedings, you agree to contact us to attempt to resolve the dispute informally. Please email [email protected] with a clear description of the issue. We will make a good-faith effort to respond within 30 days.
15. Termination
We may suspend or terminate access to the Site if we reasonably believe you have violated these Terms, created risk for the Site, or attempted unauthorized access. Termination does not limit any other rights or remedies available to us.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
16. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
17. Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Milan Movement Academy Canada Inc. regarding your use of the Site and supersede any prior agreements or communications on the subject matter.
18. Assignment
We may assign or transfer these Terms in connection with a corporate reorganization, merger, acquisition, asset sale, or other change of control. You may not assign or transfer these Terms without our prior written consent.
19. No waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. Any waiver must be in writing and signed by an authorized representative of Milan Movement Academy Canada Inc.
20. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the “Last Updated” date. Changes become effective 14 days after posting unless a different effective date is stated.
21. Electronic communications
You consent to receive communications from us electronically (for example, by email or via notices on the Site). You agree that electronic communications satisfy legal requirements that such communications be in writing.
